We accept payments through various methods, including credit/debit cards, UPI, net banking, and other payment options provided by our payment partners: Razorpay, Cashfree, and PhonePe. By making a payment, you represent and warrant that you have the legal right to use the payment method provided.

7.5 Taxes

You are responsible for paying all taxes associated with your purchases. Prices displayed include GST as applicable under Indian law.

8. SHIPPING AND DELIVERY

8.1 Delivery Partners

We partner with reputable logistics providers, including Shiprocket and Delhivery, to deliver your orders. Delivery times are estimates and not guaranteed.

8.2 Delivery Area

We currently deliver only within India. Certain areas may have restrictions on delivery.

8.3 Risk of Loss

The risk of loss and title for items purchased pass to you upon delivery of the items to the shipping carrier.

9. RETURNS, REFUNDS, AND EXCHANGES

10. INTELLECTUAL PROPERTY

10.1 Ownership

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, and software, are owned by Khushnuma or our licensors and are protected by Indian and international copyright, trademark, and other intellectual property laws.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial use.

10.3 Restrictions

You may not:

  • Reproduce, distribute, modify, or create derivative works of our content

  • Use any data mining, robots, or similar data gathering methods

  • Download any portion of our Services except as expressly permitted

  • Use our Services for any commercial purpose

11. THIRD-PARTY SERVICES

11.1 Payment Processors

We use third-party payment processors (Razorpay, Cashfree, PhonePe) to process payments. Your use of these services is subject to their respective terms of service and privacy policies.

11.2 Logistics Partners

We partner with third-party logistics providers (Shiprocket, Delhivery) for order fulfillment. These partners operate under their own terms of service.

Our Services may contain links to third-party websites. We are not responsible for the content or practices of any linked websites.

12. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KHUSHNUMA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Khushnuma and its officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any rights of another party.

15. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

16. DISPUTE RESOLUTION

16.1 Informal Resolution

Before filing a claim against Khushnuma, you agree to attempt to resolve the dispute informally by contacting us at khushnumaonline25@gmail.com. We will attempt to resolve the dispute informally by contacting you via email.

16.2 Arbitration

If the dispute cannot be resolved informally, both parties agree to resolve any claims related to these Terms through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

17. TERMINATION

  • We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

18. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Return & Exchange Policy, constitute the entire agreement between you and Khushnuma regarding our Services.
